Hold Harmless Agreement and Release of Liability
This Membership Application, Hold Harmless Agreement, and Release of Liability (“Agreement”) is entered into by and between Deviance LLC d/b/a Deviance (the “Club” or the “Business”), a Florida limited‑liability company, and the undersigned individual (the “Member” or the “Client”), effective as of the date last signed below. Collectively, the Club and the Member may be referred to as the “Parties.”

1. Introduction
   Deviance is a private membership club, not a public business. By applying for membership, joining, or attending events, you agree to abide by all Club rules, terms, and conditions outlined in this Agreement.

2. Cancellation and No‑Show Policy

3. 2.1 Non‑Refundable Fees: All membership, class, and entry fees are non‑refundable, including fees for rejected or canceled memberships or actions by the Club for any reason.
   2.2 Background Checks: All new and renewing members are subject to a search on the USDJ database of registered sex offenders. Membership will be denied to individuals listed on this database or convicted of certain violent or sexually‑based crimes. Fees are non‑refundable.

4. 3. Membership Application Requirements

5. 3.1 Eligibility: Deviance is a private club for adults (18+) interested in exploring social nudity and the BDSM arts. A valid government‑issued photo ID is required for entry. Individuals under 18 are prohibited.

6. 3.2 Acknowledgments and Affirmations: By signing this Agreement, you affirm the following:

• I am at least 18 years old and consent to public displays of nudity and sexually explicit behavior.

• I will present a valid photo ID at all Club events.

• I will not photograph or record any persons or activities without permission from Deviance and prior consent of all those being photographed.

• I will abide by all Club rules, including safe, sane, and consensual physical contact.

• I understand that violations of these rules may result in ejection or membership cancellation without a refund.

1. COVID‑19 Policy
   4.1 Compliance with Guidelines: Members must follow all Club rules, including:

• Not entering the premises if experiencing COVID‑19 symptoms or exposure within 14 days.

• Cleaning equipment, chairs, and tables after use.

• Disposing of personal trash before leaving.

• 4.2 Assumption of Risk: By entering the Club premises, you acknowledge the risks associated with COVID‑19 and voluntarily assume all responsibility for potential exposure, illness, or injury.

5. Hold Harmless Agreement and Release of Liability
5.1 Consideration: In exchange for membership, the Member agrees to pay a non‑refundable annual membership fee. Additional event fees may apply.
5.2 Confidentiality: The Club will take reasonable measures to protect Member’s personal information and will not sell or distribute it to third parties, except for operational needs.
5.3 Prohibited Activities: Members affirm that they:

• Are not registered sex offenders or law enforcement personnel acting in their official capacity.

• Will not engage in unauthorized photography or recording.

• Will not publish or distribute information about Club events without prior written consent.

• 5.4 Safety and Conduct: Members agree to:

• Engage in activities only with prior consent from other participants.

• Refrain from rude, lewd, or demeaning behavior without consent.

• Avoid sexual intercourse or masturbation on Club premises.

6. Assumption of Risk
Members acknowledge and accept the risks associated with BDSM activities, including potential exposure to bodily fluids, physical injury, or illness. Participation is voluntary and undertaken at the Member’s own risk.
7. Indemnification
Members agree not to hold the Club, its officers, staff, volunteers, or affiliates liable for injuries, damages, or losses incurred during events. Members release the Club from all claims and agree to indemnify the Club for any costs resulting from their actions or participation.
8. Agreement Terms
8.1 Perpetual Agreement: This Agreement remains in effect indefinitely, regardless of membership status.
8.2 Governing Law: This Agreement is governed by the laws of Florida, and any disputes will be resolved in Pinellas County courts.
8.3 Severability: If any provision of this Agreement is deemed invalid, the remaining provisions will remain in full force and effect.
8.4 Non‑Construction Against Drafter: This Agreement shall not be construed against the drafter.
8. Refund Policy
At Deviance, we strive to provide a welcoming and enjoyable experience for all our members. However, we understand that circumstances can change. Please review our refund policy carefully:
8.1 Membership Fees: Membership fees are non‑refundable. Once a membership is purchased and activated, it cannot be refunded, transferred, or credited toward future services.
8.2 Event Tickets: Refunds for event tickets are not provided unless the event is canceled by Deviance.
8.3 No‑Show: If you are unable to attend an event for which you have purchased a ticket, please contact us. While refunds are not guaranteed, we may be able to offer a credit or transfer on a case‑by‑case basis.
8.4 Exceptional Circumstances: In cases of extreme or unforeseen hardship, you may submit a written request for a refund. These cases will be reviewed at the discretion of Deviance management, and decisions will be made on a case‑by‑case basis.

Acknowledgment and Acceptance
By signing below, you acknowledge that you have read, understood, and agreed to the terms of this Agreement. You affirm that your participation in Club activities is voluntary and that you are waiving certain legal rights by signing this document.
IN WITNESS WHEREOF, the Parties have executed this Agreement as of the date last listed below.
